Welcome to riyang-teayard.com. By using this website you accept and agree to be bound by our Terms and Conditions and other policies we notify you of. Please read these terms carefully before placing your order to us as these terms indicate how we will provide the product to you, what to do if there is a problem and other important information.

We reserve the right at any time, to modify the present Terms & Conditions and Privacy Policy without prior notice. You will be subject to the policies and terms and conditions in force at the time you use the website or place an order from the website or other means.

YOUR ACCOUNT

You may register with us when placing orders as part of the checkout process. Please ensure any details you provide are true, correct, complete and please keep us informed of any changes to those details by updating them on the website. You are solely responsible for the activity that occurs on your account and you must maintain the confidentiality of your password and account. Please report to us if your account is being used in an unauthorised manner. We reserve the right to terminate accounts, remove or edit content or cancel orders at our discretion.

INFORMATION CONFIDENTIALITY

The personal information we collect from you when you place an order (e.g. name, email, phone number etc.) will only be used for the purposes of responding to your enquiries, fulfilling your orders, processing your payments, delivering goods to you, sending marketing communications, or maintaining your account. ORDERS

All orders for goods made by the customer on the website, by telephone or email, or other means to us are subject to these Terms and Conditions.

Our acceptance of your order will take place when we email you to confirm it, at which point a “Contract” will come into existence between you and us. The Contract is completed when the goods are delivered.

We will inform you in writing if there are circumstances we are unable to accept your order, such as order contains out of stock products, foreseeable problems affecting delivery, an error in the price or description of the product, unpaid orders, or missing information that is necessary for us to provide the products. We also reserve the right to cancel or amend any order in our sole discretion.

It is the responsibility of the customer to carefully check the information he/she provides before confirming an order. We make no guarantees that once placed and paid for, an order can be amended.

Our offers on the website are reserved exclusively for private clients, individuals or legal entities. Anyone wishing to purchase our products for commercial, business or resale purpose is invited to contact us via email at sales@riyang-teayard.com.

PRICES

All prices for products and associated costs are shown and invoiced in New Taiwan Dollars (NTD). The prices payable for the items you order include Value Added Tax which will be applied at the current rate. The delivery charge is an additional cost, it will be calculated and billed in accordance with the size of the order, place of destination, and the delivery method you select.

The final price will be indicated on the checkout page when you place your order. We take all reasonable care to ensure that the price advised to you is correct. However, it is always possible that some of the products or services (i.e. delivery) may be incorrectly priced. If there is an error we will contact you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you in 48 hours following the confirmation e-mail, your order for the incorrectly priced item will be cancelled, and we are not obliged to honour such orders.

As a result of fluctuations in exchange rates, adjustment of transport costs, all prices (including shipping charges) are subject to change without prior notice.

PRODUCT INFORMATION

We have made every effort to ensure that the goods displayed on this website conform to the descriptions and photographs. However, products may vary slightly from their pictures. Please note all images on our website are for illustration purposes only. As screens vary, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products you purchase.

PAYMENT

All payments for goods must be made in full to confirm the order. The goods will not be reserved or dispatched before payment is received. Ownership of the goods will pass to you once we have received payment in full.

Payment by credit card is immediately due and payable. Your credit card details will be encrypted for security purposes. Validation checks and authorization may apply by the card issuer when processing the payments. If the card cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled automatically.

We make our best effort and take reasonable care to keep the personal and transactional information you provide us with when placing an order, but in the absence of negligence on our part, we will not be liable to you for any losses caused by unauthorised access to any data you provide when accessing or ordering from this website.

DELIVERY

Our delivery service is available for countries specified on the website. We will do our best to ensure orders are dispatched within 1-3 working days after we accept your order but does not guarantee it if there are circumstances beyond our control.

Please ensure the delivery information you provide is correct and complete because we are unable to redirect orders once they have been dispatched. We will not be responsible for the supply delay caused by such inaccurate or erroneous information. If an order is failed to deliver to you, we will contact you for further instructions and may charge you for any costs incurred.

Please note that if you order a number of items for delivery to the same address, they may be dispatched separately and we are unable to guarantee delivery will be made by one courier visit or on the same day.

We will contact you as soon as possible to let you know if the delivery of your order delays caused by an event outside our control; however, we will not be liable for delays caused by the event.

Our orders are dispatched using TAKKYUBIN courier service for orders within Taiwan, and SF Express or Express Mail Service (EMS) courier service for international deliveries. All deliveries require a signature from you or from someone on your behalf, this is the point at which the responsibility for the purchased goods passes to you. Please note we currently do not accept delivery to PO box addresses.

The responsibility will be transferred to you after the products are delivered; therefore, the recipient (yourself or someone on your behalf) should check the condition of products on arrival. If the products are missing, lost or damaged, you must notify and file a claim with the carrier responsible and inform us immediately.

The estimated delivery lead times are as follows, please note this lead time is provided for information only and does not represent a commitment. The delivery time starts after the day of dispatch and lead times also subject to customs inspections and delays. 

 
*The delivery area of Taiwan does not include outlying islands: Penghu Is., Kinmen, Matsu, Tungying, Wuchiu, Green Is., Orchid Is., Ryukyu.
*Custom charges may apply for the delivery to China and the customer is responsible for the fees incurred. Delivery may also take longer for non-commercial addresses in China.
*Shipments delivered to non-commercial addresses or Remote Areas in Hong Kong will be subject to surcharges. Please note this surcharge is levied by the courier upon arrival and will be at the receiver’s expense.

CUSTOMS DUTIES

Orders for delivery outside Taiwan may be subject to import duties, taxes and fees. These are levied once the products reach the specified destination. You, the customer, are responsible for both declaration and fees incurred on your purchases. Please note that for items you order, you are considered the importer and must comply with all laws and regulations of the country in which you are receiving the goods.

RETURNS

You have the right to cancel your order within 14 calendar days after the day you receive the products. This right applies to all items except:

• Perishable goods such as food and beverages (including packaged teas and tea leaves) and gift boxes containing such items;
• Sealed items where the seal has been broken;
• Personalised or bespoke items

 
If you wish to cancel your purchase, please contact us as soon as possible at support@riyang-teayard.com. You will be given instructions about where to return the goods. Please note that the items listed above are excluded from this right.

Please note that should you choose to return items after we dispatch the parcel, you must send off the products within 7 calendar days from the day you receive them using any secure means. The return postage will be at your expense and we may need to deduct the original delivery charges from the refund. Please note we require the products to be in their original condition together with the accompanied accessories, bags, leaflets and the receipts on their return. The products must be returned in their original packaging, or in new packaging if the original one is damaged. It is also your responsibility to ensure that the parcel is properly wrapped and sealed. After we receive and check the products, a refund for the goods will be made within 14 days by the method you used for payment.

If the products are faulty, damaged or incorrect, you may have the option either replace (with the same or an equivalent item) or repair these items without any additional charges, or within a period of 14 days from the date of sale, provide you with a full refund including delivery for return (with the exception of the perishable and other specified goods above). However, the maximum refund for return delivery costs will be the costs of delivery we offer on the website. We may also request your support to provide photos under such cases for further investigation with the courier and packing department.

LIMITATION OF LIABILITY

Riyang Teayard will not be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, data, use, or other intangible losses, even if advised of the possibility of such damages was known or could have been known by Riyang Teayard. To the maximum extent permitted by law, Riyang Teayard’s liability shall be limited to the amount actually paid for the purchase of products from this website.

Under no circumstances will Riyang Teayard be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorised access or use of the service or your account or the information contained therein.

CONTENT & INTELLECTUAL PROPERTY RIGHTS

The website and all content and other materials therein, including but without limitation, the logos and all designs, texts, information, data, commentaries, illustrations, graphics and photographs are the proprietary property of Riyang Teayard and are protected by national and international copyright laws. Except the prior and express permission of Riyang Teayard, it is strictly prohibited to copy, download or reproduction the content on this website.

GOVERNING LAW AND JURISDICTION

These Terms and your purchase of products from Riyang Teayard through this website shall be governed by and construed in accordance with the laws of Taiwan and are under the non-exclusive jurisdiction of the Taiwanese courts. You agree that any action at law or in equity arising out of or relating to these Terms or your purchase of products shall be filed only in Taipei City, Taiwan.
